2027 Scope of Appointment Rules: What Medicare Agents Need to Know

For years, Medicare agents have dealt with a familiar situation. A client calls and says, “Can you come over today and help me understand my Medicare options?” The agent is ready. The client is ready. But the Scope of Appointment was just completed.

Under the old rules, that could mean waiting.

For 2027, CMS has made some important changes that give agents more flexibility while keeping the Scope of Appointment requirement in place.

The 48-Hour Rule Is Gone

One of the biggest changes is the elimination of the 48-hour waiting period between completing the SOA and holding a personal marketing appointment.

That means if a beneficiary contacts you today and wants to discuss their options today, you can collect the SOA and move forward with the appointment. The important part: you still need the SOA before discussing plan benefits.

How You Document the SOA Matters

For an in-person appointment, the SOA must be documented in one of several ways. That can include a wet signature, electronic signature, or qualifying electronic record. For telephone or virtual appointments, agents have more options. The SOA can be documented through an audio recording, audio-visual recording, or electronic record.

The goal hasn’t changed. Make sure the beneficiary understands what products will be discussed and properly document their permission before moving into the sales conversation.

Educational Events Get More Flexible Too

CMS also eliminated the previous 12-hour separation requirement between an educational event and a marketing event held at the same location. Agents can transition from education to marketing as long as beneficiaries are clearly notified about the change and given an opportunity to leave.

Another major change: SOAs can now be collected at educational events. That gives agents an opportunity to educate first and make it easier for interested beneficiaries to take the next step.

Don’t Forget the TPMO Disclaimer

Another change agents need to remember is timing. The updated TPMO disclaimer must now be provided before discussing plan benefits, rather than simply within the first minute of the sales call.

The disclaimer has also been updated to direct beneficiaries to Medicare.gov and 1-800-MEDICARE, with SHIPs removed as a specifically named resource for obtaining additional plan options.

Simpler Doesn’t Mean Optional

The 2027 changes remove some of the timing restrictions that made Medicare appointments more complicated for agents and beneficiaries. But the basic rule remains simple:

Get the Scope of Appointment. Document it properly. Then discuss plan benefits.

For Medicare agents, that means fewer artificial delays, more flexibility with clients, and a smoother path from the initial conversation to the appointment. And heading into AEP 2027, anything that makes the process simpler while keeping agents compliant is a welcome change.
